These Terms and Conditions set out the basis on which Rubbish Removal Waterloo provides waste collection and related services to domestic, commercial and other customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any rubbish removal, waste collection, loading, transportation, disposal, recycling, clearance or associated service provided by Rubbish Removal Waterloo.

1.2 We, us and our mean Rubbish Removal Waterloo, the provider of the Service.

1.3 You and your mean the customer who books or uses the Service, whether a private individual, business, public body or other organisation.

1.4 Booking means a request for the Service made by you and accepted by us in line with these Terms and Conditions.

1.5 Premises means the property, site or location from which waste is to be removed or at which the Service is to be provided.

1.6 Waste means any items, materials, rubbish, junk, refuse, furniture, appliances, garden waste, construction waste or other goods to be collected as part of the Service, excluding prohibited items set out in these Terms and Conditions.

2. Scope of Service

2.1 We provide waste collection and rubbish removal services in Waterloo and surrounding areas, subject to availability and access. The exact nature of the Service, including the type and volume of waste and the collection date and time, will be agreed at the time of Booking.

2.2 Our Service typically includes the loading of Waste from the Premises into our vehicle, transport and delivery to an authorised facility for reuse, recycling, recovery or disposal, in accordance with applicable waste regulations.

2.3 We reserve the right to refuse all or part of any Service where:

a) the Waste includes prohibited, hazardous or misdescribed items;

b) access to the Premises is unsafe, obstructed or unlawful;

c) provision of the Service would risk damage to persons, property or the environment; or

d) you are in breach of these Terms and Conditions.

3. Booking Process

3.1 You may request a Booking by telephone, email or through any other method we make available. You must provide accurate and complete information about the Premises, the type and approximate volume of Waste, any access issues and other relevant details.

3.2 Any quotation we provide before viewing the Waste is an estimate only, based on the information you supply. We may revise the price at the time of collection if the volume, type of Waste or conditions at the Premises differ from those described.

3.3 A Booking is only confirmed when we accept it and provide you with written or verbal confirmation of the agreed date, time window, and estimated price or charging basis. We may, at our discretion, decline any Booking without providing a reason.

3.4 You are responsible for ensuring that a person over 18 years of age is present at the Premises when we arrive to provide the Service, unless we have agreed an unattended collection in advance.

4. Service Access and Your Obligations

4.1 You must provide us with safe, clear and reasonable access to the Premises and to the Waste at the agreed time. This includes ensuring:

a) suitable parking or stopping space for our vehicles;

b) safe access routes free from excessive obstruction, hazards or health and safety risks; and

c) that any necessary permissions, permits or authorisations for access or collection are in place.

4.2 Where applicable, you must obtain consent from landlords, managing agents, neighbours, local authorities or any other relevant parties before the Service is carried out.

4.3 You are responsible for ensuring that the Waste to be collected is clearly separated from items that are not to be removed. We will not be liable for removing items that were not intended for disposal if they were not clearly separated.

4.4 You must not request us to remove any items that you do not have legal authority to dispose of. By presenting Waste for collection, you confirm that you are entitled to do so.

5. Types of Waste and Prohibited Items

5.1 We collect most common household, garden, office and commercial Waste. However, the following items are generally prohibited unless we have expressly agreed otherwise in advance:

a) hazardous or special waste such as chemicals, solvents, paints, oils, asbestos, clinical or medical waste, sharps and pressurised containers;

b) gas bottles and cylinders, explosives, ammunition or weapons;

c) industrial or commercial hazardous substances or waste requiring specialist treatment; and

d) any material that we reasonably believe may pose a risk to health, safety or the environment.

5.2 If we discover prohibited items once we arrive at the Premises, we may refuse to collect those items and may still charge you for any part of the Service already provided, together with any waiting time, additional costs or charges arising.

5.3 You must accurately describe the Waste. If we find that the Waste is of a materially different nature, volume or weight from that described at the time of Booking, we may adjust the price accordingly or decline the Service in whole or in part.

6. Pricing and Payment

6.1 Prices for the Service are usually based on the volume and type of Waste collected, any special handling required, labour time, and the distance and disposal costs involved. We will explain our pricing basis at the time of Booking.

6.2 Unless we agree otherwise in writing, payment is due in full at the time the Service is completed. We may require a deposit or full prepayment to confirm certain Bookings, particularly for large or specialised collections.

6.3 We accept the payment methods notified to you at the time of Booking, which may include cash, debit or credit card, or bank transfer. We reserve the right to change accepted payment methods at any time.

6.4 If payment is not made when due, we may:

a) suspend or withhold any further Service;

b) charge interest on overdue sums at the statutory rate applicable to commercial debts; and

c) recover from you all reasonable costs and expenses we incur in collecting overdue amounts.

6.5 All prices are quoted exclusive of any applicable VAT or other taxes unless we expressly state otherwise. Where VAT applies, it will be added at the prevailing rate and itemised on your receipt or invoice.

7. Cancellations, Rescheduling and Waiting Time

7.1 You may cancel or reschedule a Booking by giving us as much notice as reasonably possible. Cancellation terms will depend on the notice given:

a) If you cancel more than 24 hours before the agreed arrival time, no cancellation fee will usually apply.

b) If you cancel within 24 hours of the agreed arrival time, we may charge a reasonable cancellation fee to cover administration, scheduling and any costs already incurred.

c) If you cancel on arrival or fail to provide access when our team attends, we may charge a call-out fee and any associated waiting time.

7.2 If you are not present at the Premises at the agreed time and have not arranged an unattended collection with clear instructions, we may treat this as a late cancellation.

7.3 We will use reasonable efforts to arrive within the agreed time window, but times are estimates only and subject to traffic, weather, incidents and other factors beyond our control. We are not liable for any loss or inconvenience you may suffer due to delay, provided we act with reasonable care.

7.4 We reserve the right to cancel or reschedule a Booking at any time where necessary for operational, safety, legal or regulatory reasons. In such cases, any deposit or prepayment you have made for the affected Service will be refunded or applied to a new Booking, at your choice.

8. Liability and Limitations

8.1 We will exercise reasonable care and skill when providing the Service. However, you acknowledge that the removal of Waste may involve moving heavy, awkward or fragile items through confined or cluttered spaces, which carries inherent risk.

8.2 We will not be liable for:

a) any pre-existing damage to your property, fixtures or fittings;

b) damage resulting from inadequate packaging or protection of items you wish to keep;

c) loss of any item that you failed to separate or identify as not to be removed; or

d) any indirect, consequential, economic or special loss, such as loss of profit, business interruption or loss of opportunity.

8.3 Our total liability to you arising in connection with the Service, whether in contract, tort, negligence, breach of statutory duty or otherwise, shall be limited to the total amount paid or payable by you for the relevant Service, except in cases where liability cannot lawfully be limited.

8.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability may not lawfully be excluded or limited.

8.5 You are responsible for maintaining appropriate insurance cover for your property and contents. We recommend that you check your existing policies to ensure adequate protection.

9. Waste Regulations and Duty of Care

9.1 We operate in accordance with applicable UK waste management and environmental legislation and guidance. We will only transfer Waste to authorised facilities and will take reasonable steps to maximise reuse, recycling and recovery, where practicable.

9.2 Where required, we will complete a waste transfer note or similar documentation for the Waste we collect. You must provide any information reasonably required to complete such documentation accurately.

9.3 You have a legal duty of care to ensure your Waste is transferred only to an authorised carrier and managed responsibly. By using our Service, you assist in fulfilling this duty, but you must also provide truthful information about the Waste.

9.4 We may refuse to collect Waste that, in our reasonable opinion, would cause us to be in breach of any legal or regulatory requirement or would require specialist licences or facilities that we do not hold or use.

10. Data Protection and Privacy

10.1 We will collect and process personal information such as your name, contact details, address and payment information for the purposes of managing your Booking, providing the Service and handling enquiries or complaints.

10.2 We will keep your personal information secure and will not sell it to third parties. We may share your information with our employees, contractors and service providers where reasonably necessary for the performance of the Service or to comply with legal obligations.

10.3 By using our Service, you consent to the collection and use of your data for these purposes. You may request access to the personal information we hold about you and ask for corrections where appropriate, in line with applicable data protection laws.

11. Complaints and Disputes

11.1 If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible, providing full details of your concern. We will investigate and aim to resolve complaints promptly and fairly.

11.2 If a dispute arises that cannot be resolved directly between us, you and we may consider using alternative dispute resolution methods, but neither party is obliged to do so unless required by law.

12. Amendments to These Terms

12.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements or business practices. The version in force at the time of your Booking will apply to that Service.

12.2 Any material changes will be communicated or made reasonably available to you. Your continued use of the Service after such changes take effect will constitute your acceptance of the updated Terms and Conditions.

13. Severability

13.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining provisions, which will continue to be valid and enforceable.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, except where the law provides mandatory rights for consumers to bring claims in other jurisdictions.

By placing a Booking or using our waste collection and rubbish removal services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
